Union Public Service Commission (UPSC)

Context: Ms. Sujata Chaturvedi, Former Secretary, of the Department of Sports, Ministry of Youth Affairs and Sports took the Oath of Office and Secrecy as a Member, Union Public Service Commission.  

Important Pointers: 

UPSC is a constitutional body under Part XIV of the Constitution titled Services under the Union and the States.  ➤ Established under Article 315: One UPSC for the Union and State PSCs for the States. 

Composition – Article 316 

Appointment: Members (including the Chairman) are appointed by the President of India.  ➤ At least 50% of the members must have held government office for at least 10 years.  ➤ Term: 6 years or until 65 years of age, whichever is earlier.  ➤ Resignation: To the President of India. 

Removal – Article 317 

➤ A member can be removed by the President on the grounds of misbehaviour after an inquiry by the Supreme Court.  ➤ Also removable if adjudged insolvent, engages in paid employment outside duties, or becomes unfit due to infirmity. 

Functions – Article 320 

➤ Conducts exams for recruitment to All India Services and Central Services.  ➤ Advises the government on: Matters related to personnel recruitment; Promotions and transfers; and Disciplinary matters  ➤ Not binding: Advice of UPSC is not binding on the Government. 

Expenses – Article 322 

➤ UPSC’s expenses, including salaries and pensions, are charged to the Consolidated Fund of India — not subject to a vote in Parliament. 

Reports – Article 323 

➤ UPSC submits an annual report to the President.  ➤ The President lays the report before both Houses of Parliament, along with a memorandum explaining the action taken.
