Solid Waste Management (SWM) Rules, 2026
Context:
The Ministry of Environment, Forest and Climate Change (MoEFCC) has notified the Solid Waste Management (SWM) Rules, 2026, superseding the decade-old 2016 rules.
These new rules, effective from April 1, 2026, aim to integrate principles of the Circular Economy and Extended Producer Responsibility (EPR) into waste management.
Key Provisions:
The rules mandate segregation at source into four streams:
Wet waste (Kitchen/Biodegradable)
Dry waste (Recyclable)
Sanitary waste (Diapers, napkins)
Special care waste (Batteries, tube lights)
Bulk Waste Generators (BWGs): Entities are classified as BWGs if they meet any of these criteria:
Building floor area ≥ 20,000 sq. m.
Water consumption ≥ 40,000 litres/day.
Waste generation ≥ 100 kg/day.
Introduction of Extended Bulk Waste Generator Responsibility (EBWGR), placing strict onus on BWGs (approx. 30% of total waste) to process waste at the source.
Special Provisions for Hilly Areas & Islands:
Local authorities can levy user fees on tourists for waste handling.
Power to regulate the number of visitors based on the region's waste handling capacity.
Landfill Restrictions:
Landfills are restricted to only non-recyclable, non-energy recoverable, and inert waste.
Higher fees will be charged to local bodies for dumping unsegregated waste, discouraging landfill use.
Monitoring & Compliance:
A centralised online portal will ensure real-time tracking of the entire waste value chain.
Polluter Pays Principle:
Environmental compensation will be levied for violations, such as operating without registration or false reporting.
