Lok Adalat

Lok Adalat
  • Context:

  • The government recently highlighted Lok Adalats as a key mechanism for “Justice That Speaks for the People,” emphasizing accessible, compassionate, and timely resolution for every citizen.

  • About Lok Adalat:

  • Lok Adalat is an Alternative Dispute Resolution (ADR) mechanism based on Gandhian principles.

  • It is a friendly and informal forum where disputes are resolved by consensus and compromise, rather than contest.

  • It can settle cases pending in a court of law as well as matters at the pre-litigation stage.

  • Statutory Status and Powers:

  • It is given statutory status under the Legal Services Authorities Act, 1987.

  • The award (decision) made by the Lok Adalat is deemed to be a decree of a Civil Court.

  • It is final and binding on all parties.

  • There is no provision for an appeal against the award in any court of law.

  • Key Features & Benefits:

  • There is no court fee payable.

  • If a pending case is settled, the fee originally paid is refunded.

  • Parties can interact directly with the judge or conciliator, which is not possible in regular courts.

  • It ensures fast and cost-effective resolution, significantly reducing the backlog of court cases.

  • Types of Lok Adalats:

  • National Lok Adalat:

  • This is held quarterly across the country, from the Supreme Court to the Taluk level, to settle a massive number of cases in a single day.

  • Permanent Lok Adalat:

  • This is established for Public Utility Services (transport, postal, banking).

  • Unlike regular Lok Adalats, if parties fail to reach a consensus, the Permanent Lok Adalat has the jurisdiction to decide the dispute on merit.

  • E-Lok Adalat:

  • It is a digital evolution of the forum to provide justice remotely using technology.
