Dowry is a Cross-Cultural Issue
Context:
In a recent judgment involving the dowry death of a 20-year-old woman, the Supreme Court termed dowry as a cross-cultural evil that cuts across religious boundaries.
The Court noted that this practice treats women as sources of financial extraction
It directly undermines Article 14 of the Constitution, which guarantees equality before the law.
Key Observations of the court:
The practice of marrying up (Hypergamy) originates from caste and kinship structures where families seek equal or higher status alliances to enhance their standing.
This social strategy has come at a great cost to women's rights.
The Court observed that dowry has become a status marker and a part of competitive marriage negotiations, even in communities where it was not traditionally prevalent.
Dowry Prohibition Act, 1961
Indian law, enacted on May 1, 1961, intended to prevent the giving or receiving of a dowry
According to the act, dowry means any property or valuable security given or agreed to be given either directly or indirectly.
In 1984, it was changed to specify that presents/gifts given to a bride or a groom at the time of a wedding are allowed.
IPC was also modified in 1983 to establish specific crimes of dowry related cruelty, dowry death, and abetment of suicide.
Giving/taking dowry of demanding dowry is punishable offence under the act
Supreme Court Observations and Mehr:
The Court observed that although the Act was enacted to prohibit the practice, dowry has persisted by slipping through statutory definitions, often cloaked as gifts or social expectations.
The Act mandates the appointment of Dowry Prohibition Officers by State governments.
The Supreme Court has directed States to promptly appoint these officers and make their contact details public.
The Court highlighted that among Muslim families, dowry is increasingly overshadowing or replacing Mehr.
Originally, Mehr was intended to empower women through property ownership.
However, the shift towards dowry—which often ends up under the husband's control—deprives Muslim women of this traditional bargaining tool and financial security.
